YOU AGREE AND UNDERSTAND:
THIS REGISTRATION WILL NOT GUARANTEE YOU A JOB.
- If you are no longer available for work, you will CHECK-OUT IMMEDIATELY.
- Do not enter any information, as to which you wish to preserve confidentiality.
- You agree to submit ACCURATE information about your qualifications.
If CHOC discovers substantial misinformation about your qualifications, your account
will be deactivated indefinitely and your fee and any remaining time in your
registration period will be waived.
- You agree that you will not use any information received for resale.
YOU FURTHER AGREE (Terms Of Service):
I. Choc may change the Terms of Service from time to time. User will be notified of such changes. If User does not click the "I Accept" button, User's account will be terminated.
II. User will choose a User ID and Password upon acceptance of payment. User is responsible for maintaining the confidentiality of the User ID and Password and is fully responsible for all activities which occur within User's account. User agrees to immediately notify the Service of any unauthorized use of User's ID or Password or any other breach of security.
III. User agrees to abide by all applicable local, state, national, and international laws and regulations in User's use of the Service and agrees not to interfere with the use of Choc International by other Users. User agrees to be solely responsible for the contents of User's transmissions through the Service.
IV. User agrees to indemnify and hold Choc International, all affiliates, subsidiaries, officers and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of User's use of the Service, connection to the Service, or violation of the Terms of Service.
V. User agrees not to resell the Service or use of or access to the Service.
VI. User agrees that Choc International may terminate User's ID and Password or use of the Service if Choc believes User has violated any of the Terms of Service, or violates any other part of this Agreement. User acknowledges and agrees that any termination of Service under this Agreement may be effected without prior notice, and acknowledges and agrees that Choc may immediately delete User's data, or file and bar any further access to such files or the Service.
VII. USER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT USER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CHOC DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. CHOC FURTHER MAKES NO WARRANTY THAT THE SERVICE WILL MEET USER'S REQUIREMENTS, THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE. CHOC MAKES NO WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT DEFECTS WILL BE CORRECTED. CHOC MAKES NO WARRANTY REGARDING ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICE.
VIII. User agrees that Choc shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the Service or for cost of procurement of substitute services resulting from any services obtained or any other agreements or transactions entered into through or from the Service or resulting from unauthorized access to or alteration of User's transmissions or data, including but not limited to, damages for loss of profits, use, data or other intangibles. User further agrees that Choc shall not be liable for any damages arising from interruption, suspension or termination of Service, including but not limited to direct, indirect, incidental, special, consequential or exemplary damages, whether such interruption or termination was justified or not, negligent or intentional, inadvertent or advertent.
IX. The Choc terms of service and the relationship between User and Choc shall be governed by the laws of the State of New York without regard to its conflict of law provisions. User and Choc agree to submit to the personal and exclusive jurisdiction of the courts located within the State of New York. The failure of Choc to exercise or enforce any right or provision of the Choc Terms of Service shall not constitute a waiver of such right or provision. If any provision of the Choc Terms of Service is found by the court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Choc Terms of Services remain in full force and effect. User agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Choc Terms of Service must be filed within one (1) year after such claim or cause of action arose or be forever barred.

CHOC TERMS OF SERVICE (Firms)
DISCLAIMER AND TERMS OF SERVICE AGREEMENT
By using Choc, you agree to the following Terms of Service:
- You agree to provide true and accurate information about your company, yourself and the positions available in your company.
- You agree that you will not use any information contained in Choc for resale.
- You agree not to use the Service for illegal purposes or for the transmission of material that is unlawful, harassing, libelous, invasive of another's privacy, abusive, threatening, harmful, vulgar, obscene, tortious, or otherwise objectionable, or that infringes or may infringe the intellectual property of other rights of another.
- You agree that Choc International and their designees may in their sole discretion terminate your account if they believe you have in any way violated the Terms of Service.
- Please report any violations of the Terms of Service to violations@choc.net
ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE.
I. Description of Service
Choc International will provide job forms for positions available in your firm. These forms will be submitted into our database for immediate evaluation. Your firm can conduct unlimited searches for job applicants matching job requests submitted. Applicant matches will immediately appear; and other descriptive qualities of the applicants background, goals, and city preferences will broaden your knowledge of applicants qualifications for jobs submitted. Your firm can then SELECT the applicant and get his/her name, telephone number and e-mail address. Once your firm selects an applicant, one selection ("token") is used.
II. User's Registration Obligations
In consideration of use of the Service, User agrees to: provide true, accurate and complete information about job positions available in your firm. This information about User shall be referred to as "Registration Data." If any information provided by User is untrue, inaccurate or incomplete, Choc has the right to terminate User's account and refuse any and all current or future use of the Service.
III. Modifications To Terms of Service
Choc may change the Terms of Service from time to time. User will be notified of such changes. If User does not click the "I accept" button, User's account will be terminated.
IV. Member Account, Password and Security
User will choose a User ID (Screen Name) and Password . User is responsible for maintaining the confidentiality of the User ID and Password and is fully responsible for all activities which occur under User's account. V. Member Conduct
User agrees to abide by all applicable local, state, national, and international laws and regulations in User's use of the Service, and agrees not to interfere with the use of Choc International by other Users. User agrees to be solely responsible for the contents of User's transmissions through the Service.
VI. Indemnity
User agrees to indemnify and hold Choc International, all affiliates, subsidiaries, officers and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of User's use of the Service, connection to the Service, or violation of the Terms of Service.
VII. No Resale of Service
User agrees not to resell the Service or use of or access to the Service.
VIII. Termination
User agrees that Choc International may terminate User's ID and Password or use of the Service if Choc believes User has violated any of the Terms of Service, or violates any other part of this Agreement. User acknowledges and agrees that any termination of Service under this Agreement may be effected without prior notice, and acknowledges and agrees that Choc may immediately delete User's data, or file and bar any further access to such files or the Service.
IX. Dealings with Job Seekers
User's correspondence or participation with Job Seekers, including accuracy of information, availability and appropriateness for a position, are solely between User and Job Seeker. User agrees not to hold Choc International liable for any loss or damage of any sort incurred as a result of any misrepresentation by Job Seekers.
X. Disclaimer of Warranties

XI. Limitations of Liability
